These Terms of Use (“Terms”) govern your access to and use of the website pages located at clinicalathlete.com/physical-therapy and any other pages, features, forms, or services that link to these Terms (collectively, the “Site”). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
1) Who We Are (Brand, Admin, and Provider Entities)
Brand / Site Operator. The Site is owned and operated by Clinical Athlete Level Up, LLC, a New Jersey limited liability company, doing business as Clinical Athlete (“Clinical Athlete,” “we,” “us,” or “our”).
Administrative Services (MSO). Certain non-clinical administrative and management support services may be provided by Slate Health Management, LLC (the “MSO”), including scheduling support, customer support, and operational administration.
Holding Company. The MSO and the Provider Entities identified below are affiliated under common ownership through Slate Health, Inc. (Delaware corporation).
Clinical Services Provider Entities (Physical Therapy). Telehealth physical therapy clinical services (“Clinical Services”) are delivered by licensed clinicians through the applicable professional entity (each, a “Provider Entity”) depending on your location and other factors, including:
• Slate Physical Therapy, P.A. (Florida Professional Association)
• Slate Physical Therapy West, P.C. (California Professional Corporation)
• Slate Physical Therapy East, P.C. (New Jersey Professional Corporation; foreign qualified in New York)
• Slate Physical Therapy Midwest, P.C. (Kansas Professional Corporation)
Important relationship disclosure. Clinical Athlete is the consumer-facing brand you interact with on the Site. Clinical Athlete and/or the MSO may provide administrative support. Clinical decisions and Clinical Services are provided by licensed clinicians through the applicable Provider Entity.
2) Services Covered by These Terms
The Site may allow you to request information, request or schedule appointments, submit forms, and communicate with us. Services offered through or supported by the Site may include:
• Clinical Services: telehealth physical therapy delivered by licensed clinicians through the applicable Provider Entity.
• Non-Clinical Services: wellness and performance coaching, educational offerings, and other non-clinical services (collectively, “Non-Clinical Services”).
Clinical Services are telehealth-only and are provided only to individuals located in jurisdictions where the treating clinician is licensed and permitted to practice at the time of service. Non-Clinical Services are not physical therapy and are not medical care.
3) Medical Emergency; No Emergency Care
U.S. RESIDENTS: IF YOU HAVE A MEDICAL EMERGENCY, IMMEDIATELY CALL 911 OR GO TO THE NEAREST EMERGENCY DEPARTMENT.
OUTSIDE THE U.S.: IF YOU HAVE A MEDICAL EMERGENCY, IMMEDIATELY CONTACT YOUR LOCAL EMERGENCY SERVICES.
The Site and our services are not intended for emergency or urgent conditions.
4) Telehealth; Location and Eligibility
By requesting or receiving Clinical Services, you understand and agree that:
• Clinical Services are delivered via synchronous telehealth (live audio/video) sessions.
• You must be physically located in a jurisdiction where the treating clinician is licensed and permitted to provide services at the time of the session.
• We may request information to confirm your identity and location.
Clinical Services are generally offered only to individuals located in the United States. Individuals located outside the United States may be eligible for certain Non-Clinical Services only, subject to availability and applicable law.
5) Minors
If a minor receives Clinical Services, a parent or legal guardian (“Guardian”) is responsible for completing intake requirements and providing required consents. The Guardian must be present for synchronous telehealth visits (including initial evaluations and telehealth sessions), unless the applicable Provider Entity permits otherwise consistent with applicable law and clinical standards.
6) Payments, Cash Pay, and Superbills
Clinical Services (Physical Therapy). Clinical Services are cash-pay and out-of-network. We do not submit insurance claims on your behalf. Superbills may be provided upon request for eligible Clinical Services so you may seek reimbursement directly from your insurer, if applicable.
Non-Clinical Services (Wellness/Performance). Payments for Non-Clinical Services may be processed by Clinical Athlete.
HSA/FSA. Certain expenses may be eligible for payment or reimbursement via HSA/FSA depending on your plan and circumstances. We do not guarantee eligibility and recommend confirming with your plan administrator.
7) Centralized Collections / Payment Processing for Clinical Services
Depending on your location and the services you receive, you may receive Clinical Services from one Provider Entity while payments are collected or processed by Slate Physical Therapy, P.A. on behalf of the applicable Provider Entity (for administrative convenience). Your receipt or card statement may show Slate Physical Therapy, P.A. as the charging or processing entity.
This payment-processing arrangement does not change that Clinical Services are provided by the applicable Provider Entity and that clinical decisions are made by licensed clinicians.
The Site may allow you to request appointments and services. Specific scheduling rules, cancellation/no-show standards, package terms (including any expiration), subscription terms, and refund practices will be provided during intake and/or at the time you enroll, purchase, or book. We aim to apply patient-friendly standards consistent with applicable law and will communicate any applicable fees or restrictions before they apply.
9) Communications (Email and SMS)
If you submit your contact information, request a consultation, or request services, you consent to receive operational communications (including email and SMS) related to scheduling, reminders, and administrative support. Message frequency may vary. Standard message and data rates may apply. You may opt out of SMS operational messages by replying STOP (where supported) or by contacting us at team@clinicalathlete.com.
10) Privacy and Additional Policies
Your use of the Site is subject to our Privacy Policy. If you become a patient receiving Clinical Services, the applicable Provider Entity will provide a Notice of Privacy Practices (“NPP”) during intake describing how protected health information may be used and disclosed under HIPAA and applicable state laws. Additional clinical or operational policies (such as informed consent and financial policies) may also be provided during intake and are incorporated by reference when presented to you in connection with your services.
11) Prohibited Uses; Security
You agree not to use the Site for any unlawful purpose or any purpose prohibited by these Terms. You may not attempt to gain unauthorized access to the Site, accounts, or systems; interfere with Site operation; or introduce malware. We may investigate suspected violations and may cooperate with law enforcement as required.
12) Links to Third-Party Sites
The Site may contain links to third-party sites or services. Linked sites are not under our control, and we are not responsible for their content, availability, or privacy practices. Links are provided for convenience and do not imply endorsement.
13) Intellectual Property
The Site and its content (including text, graphics, logos, and materials) are owned by or licensed to Clinical Athlete and/or its affiliates and are protected by intellectual property laws. You may not copy, distribute, or create derivative works from the Site content except as permitted by law or with our written permission.
14) Disclaimers
The Site is provided “as is” and “as available.” We do not guarantee that the Site will be uninterrupted or error-free.
Non-Clinical Services are not a substitute for physical therapy or medical care. Information on the Site is provided for general informational purposes and is not medical advice. Always seek the advice of a qualified health professional regarding any medical condition.
15) Limitation of Liability
To the fullest extent permitted by law, Clinical Athlete and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Site. Nothing in these Terms limits liability that cannot be limited under applicable law.
16) Non-Discrimination
Clinical Athlete, the MSO, and the Provider Entities comply with applicable U.S. civil rights laws and do not discriminate on the basis of race, color, national origin, age, disability, sex (including pregnancy, sexual orientation, and gender identity), or any other protected characteristic under applicable law.
17) Dispute Resolution; Arbitration
If you have a dispute related to the Site, we encourage you to contact us first so we can attempt to resolve it informally.
Arbitration. Except where prohibited by law, and subject to the exceptions below, you and Clinical Athlete agree that disputes arising out of or relating to these Terms or the Site will be resolved by binding arbitration on an individual basis and not in a class, consolidated, or representative action. This arbitration provision does not prevent either party from bringing a qualifying claim in small claims court or from seeking injunctive relief to protect intellectual property or confidential information.
18) Governing Law
These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules. Clinical Services are also subject to the laws and professional practice rules of the jurisdiction where you are located and where the treating clinician is licensed.
19) Changes to These Terms
We may update these Terms from time to time. The Effective Date above reflects the most recent version. Continued use of the Site after changes means you accept the updated Terms.
