This Privacy Policy explains how Clinical Athlete Level Up, LLC d/b/a Clinical Athlete (“Clinical Athlete,” “we,” “us,” or “our”) collects, uses, and shares information in connection with clinicalathlete.com/physical-therapy and any other pages, features, forms, or services that link to this Privacy Policy (collectively, the “Site”).
1) How This Privacy Policy Relates to Clinical Care (HIPAA)
Information collected on the Site (such as contact information and scheduling requests) is covered by this Privacy Policy.
If you become a patient receiving telehealth physical therapy services (“Clinical Services”), the applicable professional entity delivering your Clinical Services (the “Provider Entity”) will provide you with a Notice of Privacy Practices (“NPP”) during intake. The NPP describes how protected health information (“PHI”) may be used and disclosed under HIPAA and applicable state laws and describes your rights regarding PHI.
Clinical Athlete and/or Slate Health Management, LLC (the “MSO”) may provide non-clinical administrative support for Clinical Services. Clinical decisions and Clinical Services are provided by licensed clinicians through the applicable Provider Entity.
2) Entities Covered and Relationship Disclosure
The Site is operated by Clinical Athlete Level Up, LLC d/b/a Clinical Athlete. Clinical Services are delivered by licensed clinicians through applicable Provider Entities, which may include Slate Physical Therapy, P.A. (Florida), Slate Physical Therapy West, P.C. (California), Slate Physical Therapy East, P.C. (New Jersey; foreign qualified in New York), and Slate Physical Therapy Midwest, P.C. (Kansas). Certain non-clinical administrative and management support services may be provided by Slate Health Management, LLC. These entities are affiliated under common ownership through Slate Health, Inc. (Delaware).
3) Information We Collect
We may collect the following categories of information:
• Information you provide: name, email address, phone number, state/location, scheduling requests, and other information you submit through forms or communications.
• Information collected automatically: device and browser information, IP address, approximate location, pages viewed, referring/exit pages, and activity on the Site via cookies and similar technologies.
• Clinical information: if you proceed to intake and receive Clinical Services, PHI and other clinical information may be collected by or on behalf of the applicable Provider Entity and handled under the NPP provided during intake.
4) How We Use Information
We use information to:
• respond to inquiries and schedule consultations/appointments;
• route you to the appropriate Provider Entity based on location and service type;
• provide administrative support (including reminders and confirmations);
• operate, maintain, and improve the Site and our services;
• conduct analytics and measure Site performance;
• maintain security, prevent fraud, and comply with legal obligations; and
• communicate with you about services you request.
We may create and use de-identified and/or aggregated information (including from service interactions) for operational analytics, quality improvement, business insights, and to improve services. De-identified information is not intended to identify you.
5) Communications (Email and SMS)
If you request scheduling or services and provide your contact information, we may send you operational communications by email and/or SMS (such as confirmations, reminders, and administrative updates). Message frequency may vary. Standard message and data rates may apply.
You can opt out of SMS operational messages by replying STOP (where supported) or by contacting us at team@clinicalathlete.com. Opting out of operational communications may affect our ability to provide certain services efficiently.
6) Cookies and Similar Technologies
We may use cookies and similar technologies for site functionality and analytics. You can control cookies through your browser settings. Some features may not function properly if cookies are disabled.
7) How We Share Information
We may share information as follows:
• With vendors and service providers that perform services on our behalf (e.g., scheduling, communications, hosting, and analytics). Vendors are required to protect information and use it
only to provide services to us. Where appropriate, we use contractual protections, including business associate agreements (BAAs) where required for PHI.
• With affiliated entities (such as Provider Entities and the MSO) as needed to route requests, support scheduling and operations, and deliver services you request.
• For legal and safety reasons, including to comply with law, subpoenas, court orders, or to protect rights, safety, and security.
We do not sell your personal information in the ordinary meaning of “sell.”
8) Cash Pay and Insurance
Clinical Services are cash-pay and out-of-network. We do not submit insurance claims on your behalf. Superbills may be provided upon request for eligible Clinical Services so you may seek reimbursement directly from your insurer, if applicable.
Some expenses may be eligible for payment or reimbursement via HSA/FSA depending on your plan and circumstances. We do not guarantee eligibility and recommend confirming with your plan administrator.
9) Data Security
We use reasonable administrative, technical, and physical safeguards designed to protect information. No system is 100% secure, and we cannot guarantee absolute security.
10) Data Retention
We retain information as long as needed for the purposes described in this Privacy Policy, including to comply with legal obligations, resolve disputes, and enforce agreements. Patient/clinical record retention is governed by the applicable Provider Entity’s clinical policies and applicable law, and is described in materials provided during intake (including the NPP).
11) Your Rights and Choices
Depending on where you live, you may have rights to access, correct, or delete certain personal information and to opt out of certain communications. To submit a request, contact team@clinicalathlete.com.
HIPAA rights regarding PHI (such as the right to inspect and copy, amend, request restrictions, and receive an accounting of disclosures) will be described in the NPP provided during intake for Clinical Services.
12) Children and Minors
The Site is not directed to children under 13. Clinical Services for minors are handled through parent/guardian consent and intake processes, and a parent/guardian must be present for synchronous telehealth visits unless otherwise permitted consistent with applicable law and clinical standards.
13) Changes to This Privacy Policy
We may update this Privacy Policy from time to time. The Effective Date above reflects the most recent version. Continued use of the Site after changes means you accept the updated Privacy Policy.
